Its promulgation marked a turning point in the establishment of the rule of law in Cambodia. Until its enactment, the country’s civil-law system had been dominated by public-law concepts that established the powers and structures of the state and delineated the duties, and only occasionally the rights, of citizens‚ a legacy of royal and Asian tradition. A coherent body of private law‚ the law that empowers citizens in their daily lives by establishing their rights and obligations to each other in their personal transactions‚ had been largely lacking, and was scattered among ad hoc Decree Laws. The new Civil Code fills this gap, providing a classic civil-law framework for the major forms of private law: the laws of persons, property and obligations. Contracts for sale, lease, employment, unjust enrichment and torts are singled out for special treatment, as are secured transactions. The laws of marriage and family, and of succession, are dealt with in detail. Civil relationships are, for the first time in recent history, clearly defined in terms of obligations and rights.

Limitations on Who Can Marry In Cambodian law, the rules regulating those who can marry fail to protect both women and men as intended. Cambodian law forbids child marriages, setting the minimum age for marriage at 18.[5] Exceptionally, a person can marry at the age of 16.[6] However, in conformity with cultural and indigenous traditions, Cambodian girls marry young. According to 2014 UNICEF statistics, 2% of girls are married by the age of 15, and 18% by the age of 18.[7] It therefore seems clear that the law is not properly enforced. The law also prohibits women from remarrying until 120 days after the day of divorce or annulment of their previous marriage.[8] This Code article has the aim of protecting the paternity rights of the first husband. The Committee monitoring the Convention on the Elimination of Discrimination against Women (CEDAW) has expressed concern that this provision is discriminatory and unduly restrictive on the right of women to remarry because today paternity can easily be established by a simple medical test.[9] However, this is not entirely applicable in the context of Cambodia. First, DNA tests are not widely accessible in Cambodia and are still too expensive for 99% of the population. Second, when a mother-to-be remarries, her new husband is by law presumed to be the father of the child.[10] If the former husband is in fact the father, he cannot claim his right to paternity.

This law defines the meaning of Merchant Trade, Trading Activities, etc. and stipulates the obligation of the companies, including the foreign business, to register and the procedures of commercial registration. The Law on Commercial Enterprise was adopted by the National Assembly on April 26, 2005, and promulgated on May 19, 2005, as the first comprehensive company law in Cambodia. This Law applies to the Partnership, which falls into the category of a General Partnership or a Limited Partnership; Limited Company, which is either a Private Limited Company or a Public Limited Company; and Foreign Business as well. A partnership or company shall continuously maintain a registered office and a registered agent, who is a legally competent natural person in Cambodia; register with the Registrar the specific location of the office and the name of the agent (Article3); and display its name in the Khmer language, which shall be placed above and shall be larger than the name in another language (Article 5).

The Ministry of Education, Youth, and Sport (MOEYS) is close to achieving universal access to primary education; the country achieved a 97.7 percent primary net enrollment rate in 2016. Cambodia has also strengthened gender parity in education, with girls comprising 48.2 percent of primary students. Cambodia has built nearly 1,000 new schools in the last ten years and has invested significant resources to expand access to a quality education. The government has committed 18.31 percent of the national budget to education in 2016. The government has been undertaking education reform aiming to improve quality of education focusing on five pillars: 1) Implementing its teacher policy action plan, 2) Reviewing curricula and textbooks, and improving school environment, 3) Implementing inspection 4) Strengthening learning assessment, and 5) Reforming higher education. Despite the gains that have been made, Cambodia has one of the highest pupil-to-teacher ratios in the region, and only 32 % of female third graders (38% of male) are proficient in Khmer literacy.

PHNOM PENH, CAMBODIA - A recent draft of the cybercrime law obtained by VOA Khmer has drawn concerns from NGOs and rights groups over clauses that could help the government intensify its crackdown on freedom of expression, while also raising privacy and data collection concerns. The draft law, the formulation of which was first announced in 2010, was intended to regulate Cambodia cyberspace, giving judicial police and courts access to investigate criminal infractions. However, an August draft of the law reveals that it could be used to further curtail freedom of expression while relying on vaguely defined scenarios to justify its implementation. VOA Khmer provided Interior Ministry Secretary of State Bun Honn a copy of the leaked draft. The official refused to confirm the authenticity of the text, although he did not reject its contents.
